Description |
This paper discusses the reasoning of Shia al-Tabatabai fiqh in his work of interpretation al-Mizan fi Tafsir al-Qur'an. Al-Tabatabai was included in the ranks of the Islamic intellectual elite in the 20th century. His intellectual ideas in the fields of philosophy, Sufism, fiqh, and tafseer had wide influence, especially among Shi'ites. Through this study, the author examines al-Tabataba's tendency around the topic of "nikah mut'ah" in his interpretations. When interpreting surah al-Nisak verse 24, he explained the permissibility of nikah mut'ah in general Syi'ah schools, based on the instructions of this verse. Opinions outside the Shi'a schools that say that the mut'ah sharia marriage has been ruled from this verse was refuted by al-Tabatabai. For example, the argument of the nasakh with (a) surah al-Mukminun verse 7, (b) al-Talaq verse 1 or al-Baqarah verse 228 regarding talaq and iddah, (c) al-Nisa 'verse 12, namely the mirats verse, (d) al -Nisa verse 23, namely tahrim verse, (e) al-Nisa 'verse 3 concerning polygamy, (f) the Prophet's hadith during the Khaibar incident, Fathu Makkah, and at the time of Hajj Wada', all of them were trying to be broken. As a result, in the interpretation of al-Nisak verse 24, he positioned himself as a defender of the Shia school of fiqh.
