Description |
Muhammad syahrur is a modern Islamic scholar who tries to re-read Islamic law and reconstruct it with contemporary readings. With the limit theory that he found, it had big implications for various readings and conclusions of the Islamic law that were different from the views of the previous jurists, including inheritance law. This research is qualitative, using an analytical descriptive method and a normative juridical approach. This study aims to find out who Muhammad Syahrur was, how the inheritance was divided according to classical fiqh, and how Muhammad Syahrur thought about Islamic inheritance law. The result, Muhammad Syahrur as a contemporary Islamic scholar uses his limit theory to change the opinion of classical scholars who have established the law of inheritance distribution based on the textual contents of the verses of the Qur'an and Sunnah. Muhammad Syahrur argues that the theory of two to one is the maximum and minimum limit that can be obtained by male and female heirs. When the number of male and female heirs is the same, then both of them can get the same portion of the inheritance.
