Description |
This article wants to describe the model of thought of Zamakhsyari in parsing verses ofabout Mediation outside the court in the Qur'an, which will be used as a legal basis for the mediation process in Islam. In order to achieve this goal, using a literature approach, this article wants to answer two important questions, namely How is the concept of mediation according to Zamakshyari in his Al-Kasysyāf interpretation, Then next, the urgency of mediation outside the court according to Zamakhsyari. Indeed scholars pay attention to the problem of interpretations of the Koran, but the focus of this article is not yet the concern of these scholars. Therefore, this study is the first step to explore the issue. This article argues that the problem of conception of mediation outside the court according to the interpretation of al-kasysyāf is the process of reconciliation carried out by both parties to the dispute, appointing judges from the men and from the women and chosen from the closest kin. Each of these judges to reconcile the two. The urgency of mediation outside the court can be a solution in resolving disputes that occur within families in general and Muslim families in particular.
