Description  Pemanfaatan kawasan hutan untuk pertanian telah di atur sedemikian rupa, berupa sistem izin pengelolaan kawasan hutan agar kelestarian kawasan hutan dapat terjamin. Akan tetapi para petani di Kecamatan Brondong Kabupaten Lamongan ini tidak memiliki surat izin pemanfaatan hutan dalam melakukan pemanfaatan hutan untuk lahan pertanian padahal di dalam Undang-undang nomor 18 Tahun 2013 Pasal 17 ayat 2b menyebutkan “Bahwa setiap orang dilarang melakukan perkebunan tanpa izin Menteri didalam kawasan hutan”.Ada dua rumusan masalah dalam penelitian ini. Pertama, Bagaimana penerapan pasal 17 undang-undang nomor 18 tahun 2013 Tentang Pencegahan dan Pemberantasan Perusakan Hutan dalam pengusaan tanah tanpa hak terhadap Hutan Produksi  dalam persepektif hukum Agraria. Kedua, Bagaimana akibat hukum terhadap Hutan Produksi yang dikuasai masyarakat untuk tanah pertanian di Kecamatan Brondong Kabupaten Lamongan.Penelitian ini merupakan jenis penelitian hukum empiris dengan pendekatan perundang-undangan (statue approach) dan pendekatan sosial makro. Sumber data yang digunakan dalam penelitian ini adalah data primer dan data sekunder. Teknik pengumpulan data dalam penelitian ini adalah wawancara, observasi dan dokumentasi.Dalam penelitian ini dapat diambil kesimpulan bahwa Proses pengusaan tanah dikawasan hutan di kecamatan brondong kebanyakan belum mengantongi surat izin dari KLHK dari 6 Lembaga Masyarakat Desa Hutan (LMDH) hanya satu LMDH yang telah mengantongi izin pengelolaan hutan KLHK. Adapun akibat hukum terhadap pengusaan tanah hutan yg dikuasai oleh masyarat tanpa adanya surat izin dari Mentri, pihak Perhutani KPH Tuban akan melaksanakan penyelidikan dan peringatan terhadap para oknum pemerintahan daerah atau desa yang menyalahgunakan wewenang untuk pemanfaatan hutan pada hutan produksi serta menangkap dan melakukan penyidikan secara tuntas terhadap masyarakat yang telah memanfaatkan hutan tanpa izin. Peringatan yang dimaksud di sini adalah pemerintah harus melaksanakan analisa terhadap pelaksanaan Peraturan Undang-Undang Nomor 18 Tahun 2013 tersebut di dalam masyarakat. Kata Kunci: Penguasaan Tanah, Pengrusakan Hutan, Hutan Produksi Utilization of forest areas for agriculture has been in such a way, in the form of a forest area management permit system so that forest areas can be guaranteed. However, these farmers in Brondong District, Lamongan Regency do not have a forest utilization permit in carrying out forest utilization for agricultural land in Law number 18 of 2013 Article 17 paragraph 2b which states "Everyone is prohibited from doing plantations without the Minister's permission in forest areas.There are two problem formulations in this research. First, how is the application of Article 17 of Law No. 18 of 2013 concerning Prevention and Eradication of Forests in the control of land without rights to Production Forests in the perspective of Agrarian Law. Second, what are the legal consequences of community-controlled Production Forests for agricultural land in Brondong District, Lamongan RegencyThis research is a type of empirical legal research with a state approach and a macro social approach. Sources of data used in this study are primary data and secondary data. Data collection techniques in this study were interviews, observation and documentation.In this study it can be concluded that the process of land tenure in the forest area in the Brondong sub-district mostly has not yet obtained a permit from the KLHK from 6 Forest Village Community Institutions (LMDH) only one LMDH has obtained a KLHK forest management permit. As for the legal consequences of land ownership controlled by the community without a permit from the Minister, the Perhutani KPH Tuban will carry out investigations and warnings against local government officials used for production forest utilization as well as arrest and conduct thorough investigations of people who have used the forest without permission. The warning referred to here is that the government must carry out the implementation of the implementation of Law Number 18 of 2013 in the community.Keywords: Land Tenure, Forest Destruction, Production Forest
