Description Abstrak Peradaban teknologi berdampak pada berbagai dimensi kehidupan, termasuk ritual keagamaan, yaitu akad nikah via teknologi informasi. Tetapi, pakar hukum Islam (fuqaha) saling silang pendapat tentang status hukumnya dan hukum positif (UU No. 1 Tahun 1974 tentang Perkawinan, amandemen tahun 2019, dan Kompilasi Hukum Islam) belum mengatur secara spesifik tentang hukum perkawinan melalui teknologi informasi. Padahal, hukum dalam kehidupan kaum muslim adalah permulaan segala aktifitas.Berdasarkan latar belakang masalagh tersebut, maka rumusan masalah penelitian ini adalah: Bagaimana maqashid syari’ah Imam Ghazali? Bagaimana hukum akad nikah via teknologi informasi prespektif maqashid syari’ah Imam Ghazali? Bagaimana relevansi maqashid syari’ah Imam Ghazali dengan pembaruan hukum keluarga Islam?Penelitian ini merupakan studi literatur (library research) dengan jenis kajian kualitatif konseptual tokoh melalui sumber data primer empat kitab ushul fiqh Imam Ghazali: al-Mankhul min Ta’liqat al-Ushul, Syifa’ al-Ghalil fi Bayan al-Syabah wa al-Mukhil wa Masalik al-Ta’lil, Asas al-Qiyas, dan al-Mustashfa min ‘ilm al-Ushul. Sedangkan data sekundernya berasal dari kitab-kitab ushul fiqh dan maqashid syari’ah. Pengumpulan data-data tersebut memanfaatkan metode dokumentasi dan teknis analisnya dengan model Miles dan Huberman dengan analisis deskriptif, analisis tekstual, dan analisis kritis.Penelitian ini menghasilkan kesimpulan: (1) Maqashid syari’ah perspektif Imam Ghazali adalah menghukumi suatu kasus hukum Islam yang belum ada sokongan dalil atasnya dengan upaya mencegah hambatan, mencari kemaslahatan, mencegah kerusakan yang berporos pada menjaga agama, jiwa, akal, keturunan, dan harta; (2) Akad nikah via teknologi informasi ditinjau dengan teori maqashid syari’ah Imam Ghazali dinyatakan sah dan sempurna (الزواج الصحيح اللازم أو التام); (3) Maqashid syari’ah perspektif Imam Ghazali memeliki relevansi kuat dengan pembaruan hukum keluarga Islam dalam menjawab kasus-kasus baru yang belum ada sokongan dalil dan memanfaatkan maslahah yang bersyarat.Kata kunci: akad nikah, teknologi informasi, maqashid syari’ah perspektif Imam Ghazali            Abstract Technological civilization has an impact on various dimensions of life, including religious rituals, namely marriage contracts via information technology. However, Islamic law experts (fuqaha) disagree about their legal status and positive law (Law No. 1 of 1974 concerning Marriage, amendments to 2019, and the Compilation of Islamic Law) have not specifically regulated marriage law through information technology. In fact, the law in the life of Muslims is the beginning of all activities.Based on the background of the problem, the formulation of the research problem is: How is Imam Ghazali's maqashid shari'ah? How is the law for marriage contracts via information technology from the perspective of Imam Ghazali's maqashid shari'ah? What is the relevance of Imam Ghazali's maqashid shari'ah to Islamic family law reform?This research is a literature study with the type of qualitative conceptual study of figures through primary data sources of four books of ushul fiqh Imam Ghazali: al-Mankhul min Ta'liqat al-Ushul, Syifa' al-Ghalil fi Bayan al-Syabah wa al- Mukhil wa Masalik al-Ta'lil, Asas al-Qiyas, and al-Mustashfa min 'ilm al-Ushul. While the secondary data comes from the books of ushul fiqh and maqashid shari'ah. The data collection utilizes the documentation and technical analysis methods using the Miles and Huberman model with descriptive analysis, textual analysis, and critical analysis.This study concludes: (1) Maqashid shari'ah from the perspective of Imam Ghazali is to punish a case of Islamic law for which there is no evidence supporting it by preventing obstacles, seeking benefit, preventing damage that pivots to safeguarding religion, soul, mind, lineage, and treasure; (2) The marriage contract via information technology is reviewed with the maqashid shari'ah theory of Imam Ghazali declared valid and perfect (الزواج الصحيح اللازم التام); (3) The maqashid shari'ah perspective of Imam Ghazali has a strong relevance to the reform of Islamic family law in responding to new cases for which there is no evidence support and utilizing conditional maslahah.Keywords: marriage contract, information technology, maqashid shari'ah Imam Ghazali's perspective.
