ABSTRACT Covid-19 is a disease caused by a type of corona virus, namely Sars-Co-V-2. Covid-19 is included in the category of force majeure, namely circumstances that arise beyond human control. As a result of the virus, the state and society experienced many losses, one of which was in the business sector, namely the termination of employment on the grounds that COVID-19 was a forced situation. Formulate the problem what are the factors for termination of employment according to the Manpower Act? Is covid-19 including overmacht? Is termination of employment as an excuse for the COVID-19 pandemic legal? This research method uses normative juridical approach with legislation (statue approach) and conceptual approach (conceptual approach). The factors for termination of employment are regulated in Law No. 13 of 2003 concerning Manpower, one of which is a state of coercion. Covid-19 is a state of coercion because it occurs beyond human control. Layoffs on the grounds of Covid-19 as a state of coercion are not legal according to law, because Covid-19 in Indonesia has only entered 1.5 years and not yet 2 years.Key words : Covid-19, force majeure, work termination. ABSTRAK Covid-19 merupakan penyakit yang disebabkan oleh jenis virus corona yaitu Sars-Co-V-2.[1] Covid-19 masuk dalam kategori keadaan memaksa/ force maajeure yaitu keadaan yang muncul diluar kendali manusia. Akibat dari virus tersebut, negara dan masyarakat mengalami banyak kerugian, salah satunya di bidang bisnis yaitu adanya pemutusan hubungan kerja dengan alasan covid-19 sebagai keadaan memaksa. Berumuskan masalah apa faktor-faktor phk menurut Undang-undang Ketenagakerjaan? Apakah covid-19 termasuk overmacht? Apakah phk sebagai alasan pandemi covid-19 sah menurut hukum? Metode penelitian ini menggunakan yuridis normatif dengan pendekatan perundang-undangan (statue approach) dan pendekatan konseptual (conceptual approach) Faktor-faktor PHK diatur dalam Undang-Undang No.13 Tahun 2003 Tentang Ketenagakerjaan, salah satunya adalah keadaan memaksa. Covid-19 termasuk keadaan memaksa karena terjadi diluar kendali manusia. PHK dengan alasan Covid-19 sebagai keadaan memaksa tidak sah menurut hukum, karena Covid-19 di Indonesia baru memasuki 1,5 tahun belum 2 tahun.Kata kunci : Covid-19, keadaan memaksa, pemutusan hubungan kerja[1] WHO, https://www.who.int/indonesia/news/novel-coronavirus/qa/qa-for-public.
